SECTION 55-248.51. Penalties for violation of chapter  

If the landlord acts in willful violation of §§ 55-248.43 , 55-248.43 , 55-248.43 or § 55-248.43 or if the landlord fails to provide a written, dated lease, the tenant is entitled to recover from the landlord an amount equal to the greater of either the tenant's monthly rental payment at the time of the violation, or actual damages and reasonable attorney's fees.
